CONSULTATION ON ENHANCING CONSUMER CONFIDENCE BY CLARIFYING CONSUMER LAW: DEPARTMENT OF BUSINESS, INNOVATION AND SKILLS

The coalition government has embarked on a programme of consumer law reform; for the benefit of consumers, traders and general business practice, creating a Consumer Bill of Rights. The RMI has submitted a detailed response to the proposals. The main objectives of the consultation are; clarification and simplification of existing consumer law, the rights of consumers and the obligations of traders in the supply of goods, services and digital content. The RMI endorses the overall aims of the paper but has vocalised concern with some proposals concentrated heavily on repair and refund and reduction for use policies. The RMI has stressed the importance of neutrality within any developed legislation and the need for flexibility to account for complex and unforeseen circumstances inevitable within business practice.

EUROPEAN COMMISSION ROADWORTHINESS PACKAGE: EUROPEAN COMMISSION

‘The objective of the ‘Roadworthiness Package’ is to support and to enforce roadworthiness testing of motor vehicles and their trailers with a view to enhance road safety and environmental protection’. This is part of a European package scheme which is aimed at reducing road fatalities. The package of reforms will also look at reducing vehicle emissions and increasing vehicle maintenance. When looking at the Commission’s proposed measures, the RMI has placed great emphasis on recommending that any measures should not create undue financial and practical burdens on the UK’s testing regime. Furthermore, the RMI has voiced particular concerns over the majority of proposals introducing new tests and the requirement of new testing equipment that these would ensure.

CONSULTATION ON A SIMPLIFIED CRC ENERGY EFFICIENCY SCHEME: DEPARTMENT OF ENERGY AND CLIMATE CHANGE

A COMMON EUROPEAN SALES LAW FOR THE EUROPEAN UNION – A PROPOSAL FOR REGULATION: MINISTRY OF JUSTICE

This consultation has been issued by Government in relation to the proposed European Commission Regulation for Common European Sales Law. The aim of the paper is to gather evidence relating to the impact, costs, potential benefits and damages of the Regulation and its implementation. The collated submitted evidence will help to form the position of the UK in relation to the Regulation. ‘The proposed Regulation will apply in business-to-consumer and business-to-business contracts where one of the parties to the contract is a Small or Medium Enterprise’.
