PRIVATE ACTIONS IN COMPETITION LAW - A CONSULTATION ON OPTIONS FOR REFORM: DEPARTMENT OF BUSINESS, INNOVATION AND SKILLS
The core reforms of the consultation are: extending the abilities and
range of the Competition Appeal Tribunal (CAT); introducing an opt-out
collection actions regime for competitive law; promoting Alternative
Dispute Resolution (ADR), and ensuring private actions compliment the
public enforcement regime. The NFDA is in support of any proposed
initiative that benefits and enhances both consumers and businesses
abilities to seek redress for anti competitive practices. The NFDA has
placed great emphasis in response to the consultation on the former and
the effects of such on SMEs who are often in a weaker negotiating
position against more powerful manufacturers. Additionally, the NFDA has
submitted that the process of redress would be improved through
enhancing the system of collective redress/representative action.
Finally, the NFDA has stated it wishes to see an extension to the
Competition Act 1998, to enable trade associations to seek redress on
behalf of their members.
