ADR AND THE CONSUMER RIGHTS BILL ADDRESSED AT INAUGURAL CROSS-INDUSTRY USED CAR FORUM

“Alternative Dispute Resolution (ADR)* and the Consumer Rights Act, plus the current and future used car market, were the key topics at the inaugural NFDA/NAMA cross-industry used car forum held yesterday”, said Sue Robinson, Director of the National Franchised Dealers Association (NFDA) which represents commercial vehicle and franchised car retailers across the UK.

Robinson continued, “The National Conciliation Service (NCS), an ADR provider that all Retail Motor Industry (RMI), NFDA and National Association of Motor Auctions (NAMA) members have access to as part of their membership, was highlighted. The NCS covers the widest range of automotive retail industry disputes.”

The inaugural forum, attended by a cross section of the industry, including franchised dealers, used car operators and auction houses provided a great platform for information, guidance, debate and discussion. This included market updates from CAP and Glass, legal and regulatory updates from TLT solicitors, briefings from NAMA on vehicle grading and the NFDA on Finance and Insurance issues.

The NFDA/NAMA led initiative promises to be the first in a line of regular events to discuss both current issues in the used car market and future developments.

  • ADR is a means of settling disputes without using the court system, often involving an independent, neutral third party, if a dispute cannot be resolved through internal processes.

  • Businesses do not have to use ADR services BUT must give customers information about ADR services

  • 1 October 2015 is the final deadline for traders to comply with the information obligation

  • Businesses can choose which ADR service they want to use

  • The NCS is an independent, Trading Standards Institute accredited service, in compliance with the UK’s Alternative Dispute Resolution Regulations

  • The NCS covers disputes over sales, repairs and services for new and used cars
